What is a Facility Emergency Response Plan — and what does it need to cover?
A Facility Emergency Response Plan (sometimes called a Facility Response Plan or FRP) is a written, site-specific document that outlines exactly how your team will detect, contain, and report a hazardous release or spill. It isn't a generic checklist downloaded from a regulatory website. It accounts for your specific materials, your specific site layout, your nearest waterways and population centers, your staffing levels, and your available equipment.
At a minimum, a compliant plan will address the following:
- A facility description with maps, drainage patterns, and proximity to sensitive receptors
- An inventory of hazardous materials stored or processed on-site with Safety Data Sheets
- Defined roles and responsibilities for emergency response personnel
- Notification procedures — who calls whom, in what order, including regulatory reporting to EPA and state agencies
- Immediate containment procedures for the most likely spill scenarios
- Location and inventory of on-site spill response equipment
- Evacuation and shelter-in-place procedures
- Coordination protocols with local fire departments, HAZMAT teams, and emergency response contractors
- A training and drill schedule
What the regulations actually require
Regulatory requirements for emergency planning vary depending on your industry, the materials you handle, and your storage volumes. The most common frameworks your facility may fall under include:
OSHA 29 CFR 1910.38 (Emergency Action Plans) — Required for any facility with 10 or more employees. Must address fire and explosion hazards, evacuation routes, and employee roles during an emergency.
EPA SPCC Rule (40 CFR Part 112) — Required for facilities storing more than 1,320 gallons of oil above-ground (or 42,000 gallons below-ground). Mandates a Spill Prevention, Control, and Countermeasure plan with engineering controls, inspections, and reporting protocols.
EPA Facility Response Plans (40 CFR Part 112.20) — Required for facilities that could reasonably be expected to cause "substantial harm" to navigable waters due to a worst-case discharge. Triggers include proximity to waterways and storage volumes exceeding thresholds.
Failing to maintain these plans — or maintaining outdated ones — exposes your facility to significant civil penalties, increased cleanup liability, and potential criminal charges for responsible officers in cases of gross negligence. More importantly, an outdated plan may actively mislead responders in an emergency.

- A communications protocol for neighboring facilities or residents who may be affected
- A defined process for securing the scene and preserving evidence for regulatory documentation
- A post-incident review process to update the plan with lessons learned
